A demand letter is a formal notice demanding the reader to execute a judicial commitment such as correcting a problem, paying a sum of money on definite terms and within a stipulated time. It gives the reader an opportunity to perform the responsibility without being taken to court.

If a demand letter is sent, it doesn’t mean that you sue the reader rather if the person doesn’t respond to the letter or do not take any action then the matter can be taken to court. In many cases, it is compulsory to send a demand letter. It allows the person to settle the matter out of court.

The letter can be sent by the client or by the lawyer, on behalf of the client and a copy of the letter should be retained by you. The original should be sent by mail since there would be a confirmation of the mail and proof of delivery. It is very important for the sender to keep a copy of the demand letters and the confirmation of delivery as a proof that a letter was sent to the recipient.

Demand letters are used in business as they are used as an attempt to maintain a good relationship with different business parties and is often used to demand a payment. It should clearly mention why a payment is claimed and what is the deadline for that payment to be made.
